These Terms of Service ("Terms") form a binding agreement between you ("Client," "you," or "your") and AugmentPath Strategy LLC ("we," "our," "us," or "Company"). These Terms govern your use of our AI-driven lead management services, including but not limited to the Digital Foundation Setup, The Auto-Receptionist, The Virtual Manager, and Enterprise plans.


By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

1. Agreement & Acceptance

We collect and process information in the following categories to provide our AI-driven lead management services:

By clicking "Get Started," "Contact Sales," or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of a business or organization, you represent and warrant that you are authorized to bind that entity to these Terms.

2. Service Description

We use the collected data for the following specific purposes:

AugmentPath Strategy provides:

AI-powered lead capture and qualification across multiple communication channels (SMS, Email, Social Media).

Automated appointment booking and customer engagement systems.

Business logic customization and campaign management.

Technical support and integration assistance (as per your service tier).

The specific features, limitations, and support levels available to you depend on the service tier you have selected and paid for.

3. User Responsibilities

You agree to:

Provide accurate, complete, and current account information.

Maintain the confidentiality of your login credentials and API keys.

Comply with all applicable laws and regulations regarding customer communication and data handling.

Use the services only for lawful purposes and not for unauthorized, fraudulent, or harmful activities.

Be responsible for all activity on your account, including but not limited to customer lists and messaging.

4. Fees & Billing

You agree to pay the fees associated with your selected service tier as displayed on our website and in your account dashboard. Fees are subject to change with 30 days' written notice. All fees are exclusive of applicable taxes unless otherwise stated.

IMPORTANT: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Pricing tiers:

  • Digital Foundation Setup: $49/mo + $997-$1,500 setup
  • The Auto-Receptionist: $197/mo + $497 setup
  • The Virtual Manager: $497/mo + $1,500 setup
  • Enterprise: Custom pricing (contact sales)

5. Payment Terms

Payment Processing: Recurring monthly charges will be billed to the payment method you provide during signup. Setup fees are charged upfront.


Failed Payments: If a payment fails, we will attempt to collect the payment using your backup payment method if available. Repeated failed payments may result in service suspension.



Refunds: Setup fees are non-refundable unless the service fails to meet agreed specifications within 14 days of purchase. Monthly subscription fees are not refundable but may be prorated upon cancellation mid-month.

6. Service Level Agreement (SLA)

Uptime Commitment: We target 99.5% uptime for our platform, measured monthly. Scheduled maintenance and force majeure events are excluded from SLA calculations.


Support Response Times: Support response times vary by service tier:

  • Tier 1 & 2: 24-48 hour response time
  • Tier 3 (Virtual Manager): 12-24 hour response time
  • Enterprise: 4-8 hour response time (SLA guarantee)


7. Prohibited Activities

You agree not to use our services for any of the following:


  • Spam, harassment, or unsolicited communications in violation of applicable laws.
  • Fraud, phishing, or deceptive practices.
  • Unauthorized access to our systems or customer data.
  • Reverse engineering, decoding, or attempting to derive the source code of our AI models.
  • Reselling or redistributing our services without authorization.

8. Intellectual Property

Our IP: All software, documentation, and intellectual property related to AugmentPath Strategy services, including our AI models, algorithms, and interface designs, are our exclusive property. You are granted a limited license to use the services as provided.


Your Data: You retain all rights to your customer data and business logic. We may use anonymized, aggregated data for service improvement and analytics, with your consent as outlined in our Privacy Policy.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: AugmentPath Strategy and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims related to these services shall not exceed the total fees you have paid us in the 12 months preceding the claim.

10. Termination

Cancellation by You: You may cancel your subscription at any time by notifying us in writing or through your account dashboard. Cancellation takes effect at the end of your current billing period.


Termination by Us: We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or fail to pay invoices after a 14-day notice period.


Data Deletion: Upon termination, you have 30 days to request deletion of your data. After this period, we may permanently delete your data in accordance with our data retention policies.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AugmentPath Strategy is incorporated, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in that jurisdiction.
